Access Alert | Artificial Intelligence in Brazil: One Step Closer to Regulation

In a growing effort towards developing more concrete Artificial Intelligence (AI) regulations, the Brazilian Senate has announced that it has invited local experts to participate in a Jurists Commission on AI. The recently appointed commission is tasked with defining principles, rules, guidelines and foundations regarding the development and application of the technology in Brazil.

The new text is set to replace three draft bills tabled between 2019 and 2021, which have previously been criticised by local stakeholders, such as Waldemar Gonçalves Ortinho Júnior, the National Data Protection Authority head. Junior called for increased, meaningful stakeholder participation throughout the various legislative process’ stages. The appointment of the new committee also follows the Council of the Organization for Economic Cooperation and Development (OECD)’s decision to open accession discussions with Brazil. This spurs incentives for regulatory convergence regarding topics such as artificial intelligence and data privacy in the country.

Previous developments regarding artificial intelligence in Brazil include the release of a national artificial intelligence strategy following the OECD’s AI recommendations, and the announcement of the creation of an AI lab network.

The Commission will have 120 days to complete the task. The group will draw up a regulation to govern the committee’s internal procedures, including rules for receiving suggestions from interested parties and holding seminars and public hearings.
