The future of trust: Why AI governance and regulation are crucial in the age of deepfakes

In 2024, a milestone in AI development was reached with Elon Musk’s Grok platform, which enables the production of photorealistic images and videos that are nearly indistinguishable from reality. While this represents groundbreaking progress in AI technology, it also raises ethical dilemmas, particularly with deepfakes: AI-generated images or videos that convincingly depict people or situations that do not really exist.

While digital manipulation to spread misinformation is nothing new, making convincing fake images or videos was once out of reach for most. Using Adobe Photoshop or After Effects required significant investment in both time (acquiring skills) and money (purchasing licences). Even then, blatant manipulations were quite easily detected.

Today, sophisticated AI platforms are freely accessible, requiring little more than a connected mobile device. This has enabled thousands to create previously unimaginable digital artworks. However, it has also led to darker pursuits that tarnish reputations and ruin lives. Around the world, women have had their likeness violated to create deepfake pornography, politicians have been depicted engaging in illegal or reprehensible activities, and unsettling events have been fabricated to sway political opinions.

As deepfakes grow more sophisticated, their potential to be weaponised for nefarious purposes, especially in the political realm, is alarmingly high. Unlike traditional forms of digital manipulation, deepfakes leverage AI to create content that is nearly impossible to distinguish from reality without advanced detection tools. Imagine a world where no one can tell whether a photo or video has been generated by AI. The very concept of ‘irrefutable proof’ becomes invalid, putting into question the very notion of ‘truth’.

The global response has been swift. Several countries are enacting or preparing legislation to curb deepfake production and dissemination. Australia has passed laws imposing strict penalties on those who create or distribute deepfake material. The European Union, China, Singapore, the United Kingdom, and the United States are tightening their regulatory frameworks, recognising the potential for AI-generated content to destabilise societies.

This surge in regulatory activity reflects a broader recognition that deepfakes pose a unique and urgent challenge. The stakes are high, affecting both the private and public sectors.

For businesses, deepfake scandals carry potential reputational and financial risks. They can damage brand credibility, lead to costly legal battles, or erode public trust. Tech companies, in particular, have a responsibility to ensure their platforms are not used to spread harmful content. For example, Google and Meta are investing in AI-detection technologies and working with policymakers to establish industry standards for responsible AI use.

For the public sector, the stakes are even higher. Governments have a duty to protect their citizens from deepfake harms, whether preventing the spread of misinformation during elections or safeguarding individuals from malicious personal attacks. Legislation must be forward-thinking, addressing current deepfake capabilities while remaining adaptable to future advancements.
